People get round it by uploading a public photo then setting it to friends only or private.

It's extremely annoying!

I had someone test this for me a while ago via a forum post. It seems it counts friends only pics as public pics for this filter. It only blocked them from messaging me when they set all their pics to private.

So people dont even neet to do any working around it if they have friends only pics.
