1. Introduction

1.1 This website is owned and operated by Winchester Consultancy Limited. Our company information is at the end of this document.

2. Definitions

2.1 Capitalised terms have the following meanings in these terms and conditions:

a) “Childlike or Minor-Presenting Sexualised Content” means any sexualised, nude, intimate, fetish, roleplay or otherwise adult Content that depicts, describes, presents, implies, suggests or is intended to evoke a person as being under 18, childlike, prepubescent, pubescent, school-age, juvenile, young-looking in a sexualised context, or otherwise not clearly an adult, whether real, fictional, staged, roleplayed, AI-generated, synthetic, illustrated, animated, manipulated, captioned or combined with other material.
b) “Commercial Use” means using the Service, any Content, any account, any profile, any message, any User information or any feature of the Service for any business, trade, professional, paid, promotional, advertising, marketing, recruitment, agency, escorting, modelling, content-selling, subscription, affiliate, lead-generation or other commercial purpose, whether direct or indirect and whether or not payment is actually received. It also includes any systematic or commercial research or data-gathering, but does not include genuinely personal, non-commercial and non-systematic use of the Service by a User.
c) “Content” means all information of whatever kind, including profiles, text, images, photos, videos, audio, posts, messages, links, usernames, handles, comments, reviews and other material, published, stored, uploaded, displayed, linked to, generated, created, edited, transmitted or sent on or in connection with our Service.
d) “Intimate Image Abuse Content” means any image, video, audio, likeness, depiction, link, request, threat, offer or other Content that involves or appears to involve nudity, partial nudity, sexual activity, sexual posing, intimate body parts, private acts, voyeurism, hidden-camera material, upskirting, downblousing, cyberflashing, non-consensual sexual material, or any real, edited, manipulated, AI-generated, synthetic, deepfaked, face-swapped or otherwise altered intimate or sexual depiction of a person, where consent is absent, unclear, withdrawn, exceeded, misrepresented, coerced or incapable of being validly given.
e) “Member” means a registered user of our Service, whether or not a subscriber.
f) “Service” means our website, the services we offer by means of our website and any related software, features, systems, tools and services.
g) “User” means any registered or unregistered user of the Service.
h) “Verification Checks” means any age assurance, age verification, identity verification, photo verification, consent verification, liveness check, payment verification, safety check, security check, fraud-prevention check or other check that we reasonably require in connection with the Service.

3. Applicability of these terms and conditions

3.1 Please read these terms and conditions carefully. They replace any previous versions. By registering on or using our Service, you agree to be bound by these terms and conditions.

3.2 These terms and conditions are available in the English language only.

3.3 You must not use the Service if you do not agree to these terms and conditions.

4. Changes to these terms and conditions

4.1 We may change these terms and conditions by posting the new version on our website.

4.2 Where changes are material, we will give you reasonable notice, for example by email or by notice when you next log in, before they take effect.

4.3 You will be bound by the revised agreement if you continue to use our Service following the effective date shown.

4.4 We may require you to accept the updated terms before continuing to use some or all of the Service. If you do not accept them, we may restrict or end your access to the Service.

4.5 If you have a subscription and you do not agree to the changes, provided that the changes are neither minor nor required by applicable law or regulations, you can end your subscription by giving us notice by a clear statement, including using this form. If so, we will refund any advance payments referable to the period after your termination, unless the law allows otherwise.

5. Forming a contract with us

5.1 By registering on our Service, you offer to enter a legal contract with us for membership of our Service.

5.2 A legally binding contract is formed if we accept you as a Member of the Service. This is in our discretion, as explained further below.

5.3 Any subscriptions, upgrades, passes or paid features you take out are part of this contract and subject to the then-current version of these terms and conditions.

6. Right to cancel (“cooling off”)

6.1 If you are a consumer, you have the right to cancel this contract within 14 days without giving any reason. If you are a consumer in the United Kingdom, this right arises under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. If you are a consumer in the Republic of Ireland or elsewhere in the European Economic Area, an equivalent right may arise under the consumer protection law applicable to you.

6.2 The cancellation period will expire after 14 days from the day of the conclusion of the contract.

6.3 To exercise the right to cancel, you must inform us of your decision by a clear statement. You may do this using this contact form.

6.4 To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

Effects of cancellation

6.5 If you cancel this contract, we will reimburse to you all payments received from you, subject to clause 6.8 below.

6.6 We will make the reimbursement without undue delay, and not later than 14 days after the day on which we are informed about your decision to cancel this contract.

6.7 We will make the reimbursement using the same means of payment as you used for the initial transaction, if feasible, unless you have expressly agreed otherwise. In any event, you will not incur any fees from us as a result of the reimbursement.

6.8 If you expressly asked us to begin the performance of services during the cancellation period, you must pay us an amount which is in proportion to the services provided up to the point at which you informed us of your cancellation, in comparison with the full coverage of the contract. We may deduct this amount from the reimbursement due to you, where permitted by law.

7. Your right to use our Service

7.1 We grant you a limited, personal, non-transferable right to use our Service on any applicable device owned or controlled by you, subject to these terms and conditions.

7.2 This right is for your personal use only. You must not transfer, sell, assign, share, lend, sublicense or otherwise make your account or access available to anyone else.

8. Who can use our Service?

8.1 You must not use, or attempt to register on, our Service if:
a) you are below 18 years of age;
b) you are below any higher minimum age that applies in the country, state, territory or location from which you access the Service;
c) display of or access to any aspect of the Service is illegal under the laws, if applicable, of the country, state, territory or location from which you are accessing the Service, including because such location does not permit such a Service or such material, or because you are under the relevant age limit there;
d) you are not legally permitted to view, access, receive or participate in the type of adult or user-generated Content available through the Service;
e) you have been convicted of any offence, or subject to any court order, relating to assault, violence, sexual misconduct, harassment, stalking, exploitation, dishonesty, fraud or any offence involving children or vulnerable persons; or
f) we have previously terminated, suspended or restricted your access to the Service and have not given you express written permission to use it again.

8.2 Any breach of clause 8.1 is a serious breach of this agreement.

8.3 We are a private membership Service. Access is only with our permission. We may decline to accept anyone as a Member where we reasonably consider it appropriate, including for safety, security, fraud-prevention, abuse-prevention, legal, regulatory, operational, community-protection or service-integrity reasons.

8.4 Access to the Service, or to parts of it, is conditional on your completing any Verification Checks that we reasonably require for safety, security, fraud prevention, abuse prevention, legal compliance, age assurance or verification integrity.

8.5 We may require you to complete Verification Checks before you register, before you access particular features or Content, and again at any time during your membership where reasonably necessary for those purposes.

8.6 We may determine the methods and standards used for Verification Checks and may change them at any time.

8.7 If you do not complete a Verification Check we require, or if a Verification Check does not satisfy us that you meet our requirements, we may decline, suspend, restrict or terminate your access to all or part of the Service.

8.8 You must provide accurate, current and complete information for any Verification Check. You must not use false, altered, synthetic, stolen, borrowed, third-party, misleading or manipulated documents, images, videos or information.

9. Acceptable use of our Service

9.1 You agree that you will not, in connection with the Service:
a) engage in any activity that breaks the law;
b) publish or send any Content, including links or references to other content, or otherwise behave in a manner which:
i) is unlawful, including depicting or suggesting unlawful acts;
ii) is defamatory, threatening, harassing, stalking, bullying, abusive, hateful, racist, discriminatory, invasive of privacy, misleading, deceptive or exploitative;
iii) infringes any intellectual property, privacy, data protection, publicity, confidentiality, contractual or other rights of others;
iv) involves phishing, scamming, fraud, impersonation, extortion, blackmail, coercion or similar conduct;
v) involves sexual exploitation, trafficking, coercion, abuse, non-consensual conduct, image-based abuse, Intimate Image Abuse Content, child sexual abuse material, underage sexual content, Childlike or Minor-Presenting Sexualised Content, or any attempt to sexualise, contact, identify or exploit a person under 18;
vi) encourages, promotes, facilitates, requests, offers, arranges or instructs any unlawful, unsafe, abusive, exploitative or non-consensual act; or
vii) we otherwise reasonably consider to be inappropriate;
c) impersonate any person or entity, misrepresent your identity, age, status, location, relationship to another person, verification status or affiliation, or otherwise mislead others;
d) publish or send any Content which links to any third-party website, profile, account, platform or service which is unlawful, inappropriate, unsafe, exploitative, deceptive, commercial, promotional or otherwise contrary to these terms;
e) sell, transfer, lend, sublicense or otherwise make available access to the Service;
f) use the Service to provide a similar service to third parties or otherwise with a view to competing with us;
g) sell advertising, sponsorship or promotions on or in connection with Content;
h) use the Service for junk mail, spam, pyramid schemes, chain letters, bulk messaging, unsolicited promotions, fraudulent schemes or similar activity;
i) do anything which may have the effect of disrupting, damaging, impairing, overloading or interfering with the Service, including worms, viruses, malware, software bombs, denial-of-service activity, mass mailings or excessive automated requests;
j) do anything which may negatively affect other Users’ enjoyment of the Service;
k) gain unauthorised access to any part of the Service, any User account, any system, any data, or any equipment used to provide the Service;
l) make any Commercial Use of the Service except where we have given you express written permission. Any permission is personal to you, may be subject to conditions, does not waive these terms, and may be withdrawn by us at any time with or without notice;
m) use any automated means to interact with our systems, excluding public search engines where we have not prohibited them from indexing public pages;
n) use the Service to publish, upload, store, send, request, solicit, create, edit, generate, alter, threaten to share, offer to share, encourage the sharing of, link to, trade, sell, buy, advertise, promote, facilitate access to, or otherwise make available any Intimate Image Abuse Content, or any intimate, sexual, nude, partially nude, private, voyeuristic, upskirting, downblousing, hidden-camera, non-consensual, exploitative or image-based abuse Content involving any person without that person’s clear, specific and freely given consent;
o) use the Service to advertise, promote, solicit, direct Users to, link to, mention for promotional purposes, or otherwise facilitate access to any external profile, social media account, messaging account, group chat, channel, server, private community, website, link aggregator, landing page, subscription page, paid-content platform, adult-content platform, cam site, creator platform, escorting or agency page, payment page, payment username, payment handle, tip jar, wishlist, affiliate link, referral link, commercial service or other off-platform destination, including by using usernames, handles, QR codes, watermarks, obfuscated links, coded references, images, profile text, messages or other Content, or to obtain followers, subscribers, customers, clients, payments, tips, gifts, traffic, leads, referrals, views, engagement or other commercial or promotional benefit;
p) bypass, evade, manipulate, test, interfere with or attempt to defeat our moderation, reporting, safety, security, anti-fraud, age-assurance, verification, payment, access-control, geolocation, rate-limiting, automated or AI systems;
q) use the Service to upload, distribute, promote, request, generate or link to AI-generated, synthetic, manipulated, edited, deepfaked, face-swapped, voice-cloned or otherwise altered Content in a way that is misleading, deceptive, unlawful, non-consensual, exploitative, impersonates any person, falsely suggests that a person has done or said anything, falsely suggests that a person has consented to anything, falsely suggests verification, disguises age or identity, circumvents our checks, or otherwise breaches these terms; or
r) attempt, encourage, assist, enable, facilitate, procure or conspire with anyone else to do any of the above.

9.2 You must comply with any rules, policies, standards, instructions or requirements displayed on or through the Service.

9.3 You must promptly comply with any reasonable request or instruction by us in connection with the Service, including in connection with age, identity, consent, photo, payment, safety, security or other verification steps.

10. Your Content

10.1 You are responsible for your Content.

10.2 You promise to us that you have, and will retain, all rights, licences, consents, permissions and legal authority needed to publish, send and make available your Content and to enable its use as contemplated by the Service, these terms and our Privacy and Cookies Policy. This includes any rights and permissions needed in relation to images, videos, likenesses, voices, names, personal information, AI-generated or AI-assisted Content, edited or manipulated Content, and any material created using third-party tools or services.

10.3 You must ensure that your profile and any other Content is and remains complete, accurate and not misleading in any way. You must update it so that it remains complete, accurate and not misleading.

10.4 You must not under any circumstances publish or send any Content which:
a) involves an image, video, audio, likeness, identifying information or depiction of any person under 18, or any higher applicable age in countries outside the UK; or
b) enables any person under 18, or any higher applicable age in countries outside the UK, to be identified or contacted, for example by name, address, email address, telephone number, social media handle, school, workplace, location or other identifying information.

10.5 You must not publish, upload, send, request, create, edit, generate, alter or otherwise make available any Childlike or Minor-Presenting Sexualised Content. It does not matter whether the person depicted or described is actually over 18 if the Content presents, implies, suggests or is intended to evoke a person under 18 or a childlike, school-age, juvenile or not-clearly-adult appearance in a sexual, nude, intimate, fetish, roleplay or otherwise adult context.

10.6 In the case of persons over 18, or any higher applicable age in countries outside the UK, you must not publish or send any Content, including images, videos, audio or identifying information, which enables those persons to be identified unless you have obtained their explicit written consent to the Content or information being provided, used and made available on the Service, and to our Privacy and Cookies Policy.

10.7 You must not send, publish, upload or otherwise make available Content depicting anyone else, whether alone, with you, in the background, partially visible or otherwise identifiable, unless you first:
a) ensure they are aware of your username and that they give you their specific written and signed consent to being included in the Content, as well as to that Content being shown publicly on the Service and potentially downloaded by other Users; and
b) verify that they are adults 18+ by getting and keeping a copy of their age ID or other evidence of age acceptable to us.

10.8 You agree to carefully store their signed consent and age ID or other age evidence, to keep only what is reasonably necessary for this purpose, to keep it secure, not to use it for any other purpose, and to provide it immediately if we ask for it. You should delete such documents when they are no longer needed for this purpose, unless you are required by law to keep them.

10.9 You must not publish, upload, send, request, create, edit or otherwise make available any Content that is AI-generated, synthetic, manipulated, edited, filtered, deepfaked, face-swapped, voice-cloned or otherwise altered in a way that is misleading, deceptive, unlawful, non-consensual, exploitative, impersonates any person, falsely suggests that a person has done or said anything, falsely suggests that a person has consented to anything, falsely suggests verification, disguises age or identity, circumvents our checks, or otherwise breaches these terms.

10.10 You must not publish, upload, send, request, create, edit, generate, alter or otherwise make available any Intimate Image Abuse Content. You must not publish, upload, send, request, create, edit, generate, alter or otherwise make available any intimate, sexual, nude, partially nude or private image, video, audio, likeness or other Content of or apparently of another person unless that person is an adult and has given clear, specific, informed and freely given consent to that exact Content being created, uploaded, shared and made available in the relevant way on the Service.

10.11 Clause 10.10 applies whether the Content is real, edited, cropped, filtered, manipulated, AI-generated, synthetic, deepfaked, face-swapped, voice-cloned, captioned, combined with other material, or appears to show the person in an intimate, sexual, nude, partially nude or private state. It also applies where the original image, video, audio or other Content was created or shared consensually but is later used, uploaded, edited, re-shared or threatened to be shared without consent.

10.12 Your Content must not contain or be used to display, promote, advertise, solicit, link to, watermark, encode, disguise, suggest or otherwise direct Users to any external profile, social media account, messaging account, group chat, channel, server, private community, paid-content platform, adult-content platform, subscription page, cam site, creator platform, escorting or agency page, payment page, payment username, payment handle, tip jar, wishlist, affiliate link, referral link, commercial service or other off-platform destination, except where we have given you express written permission.

10.13 We reserve the right without notice, and without refund save where a refund is required by law, to reject, suspend, alter, restrict, preserve, review, remove or delete Content, or to disclose relevant information, Content or evidence to law enforcement, regulators, safeguarding bodies, professional advisers, hosting providers, payment providers, complainants, affected persons or other relevant parties where we reasonably consider disclosure necessary or appropriate for safety, legal, regulatory, fraud-prevention, dispute-handling, evidence-preservation, enforcement or safeguarding purposes, subject to our Privacy and Cookies Policy and applicable law.

10.14 We may take action under clause 10.13 if the Content or behaviour is the subject of complaint, where we have reason to believe that it breaches these terms, where you have not complied with our request to provide detailed consent or age evidence for anyone shown in your Content, where such steps are necessary to protect us or others, where we believe that a criminal act has been committed, where required by law, or where requested by the police or other appropriate authorities.

10.15 We may immediately reject, remove, restrict, preserve, review, report, disclose to appropriate authorities or relevant parties, or take enforcement action in relation to any Content, account or activity where we suspect Intimate Image Abuse Content, non-consensual sexual Content, exploitation, blackmail, threats, harassment, underage involvement, Childlike or Minor-Presenting Sexualised Content, lack of consent, falsified consent, unlawful conduct or risk to any person. We may do this with or without notice and whether the issue is identified by us, automated tools, AI systems, third-party providers, Users, complainants, law enforcement, regulators or others.

10.16 It is your responsibility to decide which Content to publish or send, subject to these terms and conditions. To the extent permitted by law, we do not accept responsibility if your Content is misused by others, as this is outside our reasonable control. Do not send or publish any Content if you are concerned that it may be misused.

10.17 It is your responsibility to make your own backup of any Content stored within the Service to protect you in case of loss or damage to such material. To the extent permitted by law, we are not responsible for such loss or damage.

10.18 We may irretrievably delete all of your Content if this contract ends. You should make a backup of any Content that you wish to keep.

10.19 Any Content that you publish must be only for the purposes of meeting or interacting with other Members and must not be published through our platform for any other reason.

11. Other Users and their Content

11.1 We may in our discretion carry out User verification steps. Such steps are not foolproof and we do not guarantee that they will identify every issue.

11.2 We do not endorse, recommend, guarantee or vouch for any Users, profiles, photos, ages, identities, verification statuses or other Content, even if a User, profile, photo, age, identity or Content is shown as verified, checked, approved or moderated, whether by us, automated systems, third-party providers or other Users.

11.3 You deal with other Users at your own risk. To the extent permitted by law, we accept no legal responsibility for the accuracy of, or otherwise in relation to, any such Content or in connection with any dealings between Users.

11.4 It is your responsibility to carry out careful and detailed investigations before dealing with other Users, including use of or reliance on their Content. You should not assume that any Content from another User is accurate and you should be aware that a person may not be who he or she claims to be.

11.5 You acknowledge that in using the Service you may be exposed to inappropriate Content or behaviour. If so, please contact us by clicking on the “Report Profile” link adjacent to the relevant profile or by using any other reporting tools we make available. If appropriate, you should seek relevant external help, for example from law enforcement authorities, and/or stop using the Service.

11.6 When arranging to meet others through our Service, you must take appropriate precautions and follow any safety guidelines on our Service. We cannot control what actually happens at such meetings, which are at your own risk and are not our responsibility, except to the extent that we are at fault or the law says otherwise.

12. Third-party services, advertising and websites

12.1 We may display third-party-provided services or third-party advertising within our Service and/or link to third-party websites, profiles, platforms, services or resources which may be of interest to you.

12.2 We do not recommend or endorse, nor are we legally responsible for, those sites, services, platforms, resources or advertisements, except to the extent that the law says otherwise. You use them at your own risk.

13. Guidance

13.1 If we ourselves provide any guidance, safety information, help material, recommendations or other general information on our Service, we cannot guarantee that it is accurate, complete, suitable for you or up to date.

13.2 To the extent permitted by law, we do not accept legal responsibility for such guidance or information. Before acting on such information, you must make your own appropriate and careful enquiries, including as to its accuracy and suitability for your purposes.

14. Your account

14.1 Unless otherwise specifically stated on our Service, your account is for your personal use only and is non-transferable.

14.2 You must not authorise or permit any other person to use your account.

14.3 You must not create, use or control more than one account, create accounts on behalf of others, use another person’s account, allow another person to use your account, or attempt to re-register after suspension, restriction or termination, except with our express written permission.

14.4 You must take reasonable care to protect and keep confidential your password and other account, login, security or identity information.

14.5 You must notify us immediately of any apparent breach of security, including loss, theft, misuse, unauthorised disclosure or unauthorised use of a password, login, device, account or identity information.

14.6 You are responsible for third parties who use your account or identity, unless and to the extent that we are at fault.

15. Payment

15.1 While parts of our Service are available to Users free of charge, certain features are available only to Users who upgrade, subscribe, purchase a pass or otherwise pay for access.

15.2 Upgrades, subscriptions, passes and paid features can be acquired at the prices, for the periods and by the payment methods specified on our Service.

15.3 Payment is in advance.

15.4 The prices shown on our website include any applicable VAT unless we say otherwise.

15.5 Unless we state otherwise at the time of purchase, paid access, subscriptions, upgrades, passes and paid features are personal to your account and are non-transferable.

15.6 If any payment is unpaid, declined, reversed, charged back, suspected to be fraudulent or otherwise not received by us, we may suspend, restrict or terminate access to the relevant paid features or to the Service.

15.7 You must not make unjustified chargebacks or payment disputes. We may treat an unjustified chargeback, payment reversal or payment dispute as a serious breach of these terms.

15.8 Refunds are available only as stated in these terms, as stated on the Service, or where required by law.

16. Functioning of our Service

16.1 We do not guarantee that the Service will be uninterrupted, secure, available, compatible or error-free.

16.2 We are entitled, to the extent permitted by law and without notice or liability, to suspend the Service for repair, maintenance, improvement, security, legal, operational or technical reasons and to make changes to the Service.

16.3 If the Service is materially interrupted and you have upgraded, subscribed or purchased a pass, we will extend your paid access by at least the duration of the material interruption, unless the interruption was caused by you, by matters outside our reasonable control, by your breach of these terms, by your failed payment, or by suspension or restriction of your account under these terms.

17. Ending, suspending or restricting this contract

17.1 You may at any time end this contract, meaning stop being a Member, by deleting your account in accordance with the instructions on our Service. This does not entitle you to a refund unless you have cooling-off rights as explained above, unless we expressly state otherwise, or unless the law says otherwise.

17.2 We are entitled to end this contract at any time for any reason, whether with or without notice. If we do so, we may at our discretion close, disable, remove or irrevocably delete your account and any associated Content. We will refund in full any fees already paid which relate to the period after termination, unless the law permits otherwise.

17.3 We may end this contract whether with or without notice if we terminate the Service as a whole. If so, we will refund any subscription fees already paid which relate to the period after termination, unless the law permits us not to do so.

17.4 We may, with or without notice, suspend, restrict, remove features from, decline to renew, or terminate your account, membership, subscription or access to all or part of the Service where we reasonably consider that:
a) you have breached these terms or any rules, policies, standards, guidance or requirements on the Service;
b) you have failed, refused or been unable to complete Verification Checks or other age, consent, identity, payment, security or safety checks;
c) your account, Content, behaviour, device, payment, network activity or other activity presents or may present a risk to us, Users, third parties, the Service, the community, our systems, our reputation, our legal position or our regulatory compliance;
d) automated systems, AI tools, third-party providers, user reports, moderation review, payment providers, law enforcement, regulators or other signals indicate possible abuse, illegality, fraud, spam, scamming, underage access, Childlike or Minor-Presenting Sexualised Content, non-consensual Content, duplicate accounts, fake accounts, platform manipulation, security risk or other misuse;
e) fees are unpaid, disputed, reversed, charged back or suspected to be fraudulent;
f) we are required or requested to do so by law, regulator, court, law enforcement body, payment provider, hosting provider or other relevant authority or service provider;
g) we discontinue, restructure, replace or materially alter the Service or any part of it; or
h) we otherwise reasonably consider the action necessary or desirable to protect the Service, Users, third parties, the community, our business, or the proper operation of the Service.

17.5 If we end, suspend or restrict your account under clause 17.4 because of breach, suspected breach, failed verification, non-payment, chargeback, misuse, risk, safety, security, fraud-prevention, legal, regulatory or community-protection reasons, you will not be entitled to a refund for any period of suspension, restriction or unused subscription period, except where the law requires otherwise.

17.6 The restrictions referred to above include preventing you from accessing public postings such as forums, chat and club reviews, preventing you from making public posts, restricting messages, restricting profile visibility, restricting uploads, removing verification status, disabling features, limiting search visibility, or preventing access to some or all parts of the Service.

17.7 If this contract ends:
a) your right to use our Service and all licences granted to you are terminated;
b) we are entitled to delete all of your Content;
c) existing rights and liabilities are unaffected;
d) all clauses in this contract which are stated or intended to continue after termination will continue to apply; and
e) you must not attempt to re-register for or continue to use our Service if we have given you notice of termination, suspension or restriction, unless and until we give you express written permission or any suspension or restriction is lifted.

18. Liability

18.1 Nothing in this agreement in any way limits or excludes our liability for negligence causing death or personal injury, fraud, fraudulent misrepresentation, breach of your statutory rights where they cannot legally be excluded, or anything else which may not legally be excluded or limited.

18.2 In this section, any reference to us includes our employees, officers, contractors, service providers and agents.

18.3 If you are a consumer, nothing in this agreement affects your statutory rights, including any right to services performed with reasonable care and skill, which cannot lawfully be excluded.

18.4 Very important: To the extent permitted by law, we shall not be liable for any loss or damage caused by us or our employees, officers, contractors, service providers or agents in circumstances where:
a) there is no breach of a legal duty owed to you by us or by any of our employees, officers, contractors, service providers or agents;
b) such loss or damage was not reasonably foreseeable, meaning it was not an obvious consequence of our breach and was not contemplated by you and us at the time we entered into this contract;
c) such loss or damage is caused by you, for example by not complying with this agreement;
d) such loss or damage relates to a business of yours;
e) such loss or damage arises from another User’s Content, conduct, identity, age, verification status, behaviour, communications or meetings with you;
f) such loss or damage arises from your decision to publish, send, disclose, share or make available Content or information through the Service; or
g) such loss or damage arises from moderation, verification, age-assurance, anti-fraud, safety, security, restriction, suspension or termination decisions where we have acted reasonably and in accordance with these terms, except where the law says otherwise.

18.5 We do not guarantee that the Service, any User, any Content, any Verification Check, any moderation process, any automated system, any AI system, any safety tool or any third-party provider will identify every issue, prevent every risk, or be free from error.

18.6 Very important: You will be liable for any reasonably foreseeable loss or damage we suffer arising from your breach of this agreement or misuse of our Service, subject to our obligation to mitigate any losses.

19. Intellectual property rights

19.1 The intellectual property rights in all material used on or in connection with our Service are owned by us, our licensors, our service providers or other Users.

19.2 For your personal use only, you may view such material on your device. You must not otherwise use such material, including copying, selling, adapting, extracting, downloading, recording, scraping, redistributing, republishing, training on, or taking extracts from it, without our specific prior written consent.

19.3 Just to be clear, you must not collect, scrape, harvest, extract, copy, index, crawl, mine, frame, deep-link to, train on, analyse at scale, monitor or otherwise use any Content, User information or data from the Service without our specific prior written consent, including for training, fine-tuning, evaluating, developing or operating any artificial intelligence, machine-learning, facial-recognition, search, analytics, advertising, profiling, data-broker, competitive or commercial service.

19.4 You must not circumvent or otherwise interfere with any security-related features of the Service or features that limit or prevent copying of Content or which restrict use of Content.

20. Privacy

20.1 We process personal information in accordance with our Privacy and Cookies Policy, as updated from time to time.

20.2 Our Privacy and Cookies Policy explains how we process personal information for purposes including account administration, moderation, safety, security, fraud prevention, spam prevention, abuse prevention, verification, photo verification, facial analysis, age assurance, identity checks, legal compliance, analytics, service improvement, AI-assisted functions and communication with Users.

20.3 Our Privacy and Cookies Policy contains further detail about the automated processing, Verification Checks and age assurance described in clause 25.

20.4 If you provide information about another person, including images, videos, identification, consent records or verification materials, you are responsible for ensuring that you are legally entitled to provide it and that the person has been given any required privacy information.

21. Events outside our control

21.1 We are not liable for failure to perform or delay in performing any obligation under this agreement if the failure or delay is caused by any circumstances beyond our reasonable control, including third-party telecommunication failures, hosting failures, power failures, payment-provider failures, cyberattacks, labour disputes, changes in law, regulatory action, war, terrorism, civil unrest, natural disasters, epidemics, pandemics or other events outside our reasonable control.

22. Transfer

22.1 We may transfer all or part of our rights or duties under this agreement provided we take reasonable steps to ensure that your rights under this agreement are not prejudiced.

22.2 As this agreement is personal to you, you may not transfer any of your rights or duties under it without our prior written consent.

23. English law

23.1 This contract is under English law.

23.2 Any disputes will be decided by the courts of England and Wales.

23.3 If you are a consumer resident elsewhere, you may also have the right to bring proceedings in the courts of the country in which you live, and to rely on mandatory consumer protections of that country which cannot be excluded by agreement.

24. General

24.1 We may send all notices under this agreement by email to the most recent email address you have supplied to us or by private mail, internal message or other notice through the Service.

24.2 Headings used in this agreement are for information only and are not binding.

24.3 Any failure by either party to exercise or enforce any right or provision of this agreement does not mean this is a waiver, meaning that it cannot be enforced later.

24.4 If any part of this agreement is ineffective or unenforceable for any reason, the rest of the agreement shall continue to apply.

24.5 A person who is not a party to this agreement shall have no rights to enforce this agreement except insofar as expressly stated otherwise.

24.6 The parties are independent contractors and, except as otherwise specifically stated above, nothing in this agreement constitutes any party as agent, employee, partner or representative of the other.

25. Automated processing, moderation, verification and age checks

25.1 We may use automated systems, artificial intelligence, machine-learning tools, rule-based systems, facial analysis technologies, third-party verification providers and human review to operate, protect, moderate, secure, verify, improve and enforce the Service.

25.2 These tools may be used for purposes including content moderation, report triage, detecting or reducing unlawful Content, Intimate Image Abuse Content, Childlike or Minor-Presenting Sexualised Content, underage access, fake accounts, duplicate accounts, spam, scams, fraud, abuse, harassment, security threats, payment misuse, ban evasion, platform manipulation, prohibited Commercial Use, and other behaviour or Content that may breach these terms or create risk.

25.3 As part of identity verification, photo verification, liveness checks and age assurance, our systems or service providers acting on our behalf may analyse images, videos or other information you submit. This may include automated analysis of facial features to assess whether a person appears to be present and live, compare images submitted by you, check whether images meet our requirements, estimate age range, support age verification, support photo verification, detect misuse of images, or protect Users and the Service.

25.4 Where explained in our Privacy and Cookies Policy, we may also use verification, account, device, technical, behavioural, payment, moderation or safety signals to detect duplicate accounts, fake accounts, ban evasion, fraud, abuse, underage access, non-consensual Content, Childlike or Minor-Presenting Sexualised Content or other misuse.

25.5 Automated systems and Verification Checks are not perfect. They may produce incorrect, incomplete or unexpected results. We may act on indicators, probabilities, risk scores, automated classifications, matching results, age-assurance results, user reports, internal signals, third-party signals, manual review or any combination of these. We do not have to prove a breach to a legal or criminal standard before taking action under these terms.

25.6 We may reject, remove, demote, restrict, blur, quarantine, block, suspend, terminate, delay, manually review, require further verification, request evidence, limit visibility of, or otherwise take action in relation to any Content, account, message, feature, payment, subscription, device, IP address, login, verification status or activity where we reasonably consider it necessary or desirable for safety, security, compliance, community protection, service integrity, fraud prevention, age assurance, legal risk, regulatory risk, operational reasons or enforcement of these terms.

25.7 Further detail on how we process personal information, the Article 6 lawful basis on which we rely, any special-category condition we rely on where facial analysis generates biometric data, our retention practices, automated decision-making, safeguards, suppliers and your rights is set out in our Privacy and Cookies Policy. Where required, we maintain appropriate data protection documentation and safeguards for this processing.

25.8 Unless stated otherwise in our Privacy and Cookies Policy, we do not intentionally retain biometric templates for the purpose of uniquely identifying you after the relevant check has been completed. However, facial images, videos, technical outputs, confidence scores, age-estimation outputs, verification results, audit logs and related records may be processed and retained where needed for safety, security, fraud prevention, legal compliance, dispute handling, audit, enforcement, record-keeping or as otherwise explained in our Privacy and Cookies Policy.

25.9 Where reasonably practicable and where required by applicable law, we may offer an alternative verification method that does not use automated facial analysis. Any alternative method may take longer, may require different evidence, may not be available for all features or risk scenarios, and must still satisfy our verification requirements. We may decline, suspend or restrict access to all or part of the Service if you do not complete a verification method that we reasonably require, or if the method used does not satisfy us that you meet our requirements.

25.10 Decisions that significantly affect you, such as declining, suspending or removing access, are not based solely on automated processing without the possibility of human review where such review is required by applicable law. Where required by law, you may request human intervention, make representations or contest such a decision using the form referred to in clause 26.1. We will respond within any timeframe required by applicable law or, where no specific timeframe applies, within a reasonable period.

25.11 Passing any verification, photo-verification, age-assurance or moderation process does not mean that we endorse, recommend, guarantee or vouch for any User, account, profile, Content, age, identity, intention, conduct or suitability. Verification and moderation processes are protective tools only and are not foolproof.

26. Complaints, reports and appeals

26.1 If you have any complaints, please contact us via this form.

26.2 If you wish to report Content, behaviour, a User, a safety issue, intimate image abuse, underage use, Childlike or Minor-Presenting Sexualised Content, non-consensual Content, impersonation, fraud, harassment or another breach, you should use the reporting tools provided on the Service or contact us using this form.

26.3 We may review, prioritise, investigate, reject or take action on reports at our discretion and/or where required by law.

26.4 We may not tell you the outcome of a report where doing so would affect safety, privacy, enforcement, investigations, legal obligations or the rights of others.

26.5 Where required by law, we will provide a route to appeal or request review of certain moderation, verification or access decisions. In other cases, we may provide such a route at our discretion.
